Trump’s docs trial proposal 'almost seems reasonable' — but it’s 'highly problematic': legal expert



Former President Donald Trump on Thursday requested that the trial for his Mar-a-Lago classified documents not begin until after the 2024 election — or, at the earliest — August 12. MSNBC legal correspondent explained to The ReidOut host Joy Reid why the MAGA hopeful's August 12 proposed date may seem like a "reasonable" date — but is not.

"Could Jack Smith simply charge Donald Trump with something else? say, 'Now I'm charging with you insurrection'? Reid asked. "Straight up — same thing he was charged in Colorado. Xerox, photo copy the indictment — say, 'I'm charging him with that now?"

Rubin replied, "I'm not sure, because I think that any new charges on the federal level would still be susceptible to this immunity defense. So that, if the court is going to consider whether a former president is immune from criminal prosecution for any acts that he committed essentially while he was in office, which is how Trump would define 'official acts', then we're still back to square one."

She continued, "I also want to point out that the date that Trump has proposed to try Judge Cannon's case is itself highly problematic because by proposing August 12, it almost seems like he's being reasonable, but he's not. If you read the entirety of the submission tonight that he made to Judge Cannon, he is all but inviting her to stay that case for a litany of reasons. Including but not limited to the outstanding question of presidential immunity. But in the alternative, he's offering her this August 12 date. And what is magical about August 12? Not only will he be the nominee by then, but by starting a trial that he estimates will take eight to ten weeks on August 12, guess who else would be blocked from ever trying her case before the election? [Judge] Tanya Chutkan. No matter what the Supreme court does."
